Scope of Application

These General Terms and Conditions apply to all legal transactions between INNES GmbH, FN 378191p, Favoritenstrasse 4-6/1/1, 1040 Vienna, Austria (hereinafter “INNES”), especially those concerning services rendered within the scope of German courses, and its customers. The version valid at the time of contract conclusion shall be applicable. The General Terms and Conditions shall remain applicable for future legal transactions as well, whether or not this is explicitly specified within the scope of supplementary contracts. In case individual provisions of the present General Terms and Conditions should be inapplicable or become invalid, this shall not affect the validity of other provisions, or of the contracts concluded thereunder. Each invalidated provision shall be replaced by a new provision, corresponding in sense and economic purpose with the abrogated stipulation.

Conditions of Participation

Should participation in a particular course be subject to certain admission requirements (e.g. placement test, minimum age, etc.), these requirements shall be explicitly mentioned in the course description and shall be met by all participants.

 

Registration and fees

The course fees are due immediately after your registration. Please fill out the online form and submit it. You will be requested to provide the course fee by an immediate bank transaction to our account using one of our payment providers. Please use the invoice number as payment identifier.

If the booked course begins within the 14-day cancellation period in accordance with paragraph 5., you expressly agree that INNES may begin to fulfill the contract before the end of the cancellation period.

 

Right of Withdrawal for consumers for distance selling contracts and for contracts concluded outside of business premises – cancellation instructions

a. Right of Withdrawal

In the case of completing your registration for a course online or via phone, you have the right to cancel this contract within fourteen days from the day the contract was concluded without stating a reason. You can use the sample withdrawal form attached below in this point, although its use is not mandatory.

In order to exercise your right of withdrawal, you must inform us of your decision to withdraw from this agreement by means of a clear statement (e.g. by mailed letter or e-mail at info@innesvienna.net). The withdrawal period has been observed so long as you dispatch the notification of your exercise of the right of withdrawal prior to the end of the withdrawal period.

b. Consequences of the withdrawal

If you withdraw from this agreement, we are obliged to reimburse all payments which we have received from you immediately and at the latest within fourteen days from the date on which we receive your notification of withdrawal from this agreement. For this repayment we will use the same method of payment which you used for the original transaction, unless something different is explicitly agreed with you; in no case will you incur any fees as a result of this repayment.

Has the service provided started within the period of withdrawal, you have to pay an appropriate fee which corresponds to the part consumed until notification of withdrawal was issued.

The right of withdrawal exists only for consumers and only for contracts concluded away from business premises and in the context of so-called distance contracts, i.e. contracts in which the trader or a person acting in his name or on his behalf and the consumer use exclusively means of distance communication for the negotiation and conclusion of the contract, unless the conclusion of the contract does not take place within the framework of a distribution or service system organized for distance selling. Means of distance communication are all means of communication that can be used to initiate or conclude a contract without the parties to the contract being physically present at the same time.

 

Cancellation policy

Cancellation of a German course or educational program after the expiry of any statutory right of withdrawal in accordance with point 5. or in the case of completing your registration for a course or education program in-person is subject to the following conditions:

  • 24-hour money back guarantee: if you cancel within 24 hours after your registration and payment, you receive the full amount back.
  • Up to 30 days before the course or education program start: you receive the full amount back, reduced by 10% administrative fee, but at least EUR 44.00.
  • 29 – 15 days before the course or education program start: you receive 70% back.
  • 14 – 7 days before the course or education program start: you receive 50% back.
  • from 6 days before the start of the course or educational program: there will be no refund of the course price.

Only cancellations by email are accepted.

 

Modification of course program / Cancellation of the course

INNES holds the right to make course modifications. Due to long-term planning, we cannot rule out program changes.

By the same token, whether a course is held depends on whether the required minimum number of 4 participants sign up for the level. Therefore, INNES reserves the right to change course days, starting times, course venues and trainers. INNES reserves the right to cancel courses in case of less than 4 participants signing up. In this case all course fees paid will be reimbursed.

In the case of 4 participants signing up for the course, INNES reserves the right to shorten the course by 20%.

The above-mentioned changes or cancellations do not entitle anyone affected to reimbursement for expenses incurred and/or any other claims against INNES. The same shall apply to necessary short-term changes in the course schedule. If a course cancellation becomes necessary, the full amount paid by the customer shall be refunded. INNES assumes no liability for clerical or printing errors in its publications and websites.

 

Public holidays

No teaching takes place on public holidays. Lessons lost due to public holidays are compensated on other days during the course periode. There will be no pro rata reimbursement of the course costs.

 

Course Certificate

In order to be issued a certificate at the end of the course, participants are required to attend a minimum of 80% of classes and achieve positive grades in the continuous tests. The certificate provides information regarding the completed course phase according to the Common European Framework of Reference for Languages. Course certificates shall be issued upon requirement free of charge to all participants who have attended a minimum of 80% of their respective classes.

 

Confirmation of attendance

If the criteria for receiving the course certificate are not met, confirmation of attendance can be issued upon request. Confirmation of attendance provides information about the course level and the number of learning units completed by the course participant.

 

Photos and videos

By registering for a German language course, you consent that any photos & videos taken of you at INNES venues can be published in the INNES promotional material or on the Internet. If you do not consent, you have to notify us in writing before the start of the course.

 

Disclaimer

INNES does not accept responsibility for loss or theft of personal effects, including the learning materials made available. INNES provides the teaching infrastructure, while the responsibility for individual learning success lies with each participant. No guarantees can be issued for learning success.

 

Disability

In order to discharge our obligations under the Disability Discrimination Act, disabled customers are asked to provide sufficient information at the time of booking with regard to their disability to enable us to consider whether reasonable adjustments can be made to accommodate them.

 

Final provisions, applicable law and place of jurisdiction

Contract amendments and modifications of the present General Terms and Conditions require the written form to be legally valid; this shall also apply to a waiver of this formal requirement. Verbal ancillary agreements are not acceptable. The place of jurisdiction is the city of domicile of INNES. The contractual relationship is subject to Austrian substantive law under exclusion of conflict rules and CISG (United Nations Convention on Contracts for the International Sale of Goods). In case of litigation deriving from or in connection with this contractual relationship, including litigation regarding its validity, the parties agree upon the exclusive jurisdiction of the competent court in the city of domicile of INNES, unless precluded by mandatory rules.

 

Data Privacy Protection

Participants‘ private information shall be saved and processed electronically and treated with utmost confidentiality. Your personal information shall neither be divulged nor made available to third parties, except to fulfil legal obligations, and shall be utilized exclusively for internal purposes. In order to ease the internal communication, the personal information entered in the application may be given to teachers or other INNES staff.
