1. Scope of Application
These General Terms and Conditions apply to all legal transactions between INNES GmbH, FN 378191p, Favoritenstrasse 4-6/1/1, 1040 Vienna, Austria (hereinafter “INNES”), especially those concerning services rendered within the scope of German courses, and its customers. The version valid at the time of contract conclusion shall be applicable. The General Terms and Conditions shall remain applicable for future legal transactions as well, even if not explicitly stated in subsequent contracts. In case individual provisions of the present General Terms and Conditions should be inapplicable or become invalid, this shall not affect the validity of other provisions, or of the contracts concluded thereunder. Each invalidated provision shall be replaced by a new provision, corresponding in sense and economic purpose with the abrogated stipulation.
2. Course fee
The course fee for classroom or online courses includes:
- Full tuition as stated
- Tests
- End-of-course certificate
- Course books
3. Conditions of Participation
Should participation in a particular course be subject to certain admission requirements (e.g. placement test, minimum age, etc.), these requirements shall be explicitly mentioned in the course description and shall be met by all participants.
4. Registration and fees
The course fee is due immediately upon registration. After submitting the online form, you will be asked to pay the course fee via immediate bank transfer using one of our payment providers. Please use the invoice number as the payment reference.

Please complete and submit the online form. The course fee is due immediately and can be paid via bank transfer or through one of our payment providers. When paying by bank transfer, please indicate the course, course number, and your name in the reference field.

5. No Right of Withdrawal pursuant to Section 18 (1) (10) FAGG
Pursuant to Section 18 (1) (10) of the Austrian Distance and Off-Premises Contracts Act (FAGG), consumers are not entitled to a right of withdrawal if the contract concerns leisure-related services to be provided at a specific date or within a specific period. This applies to our language courses, which are booked for a defined period. Accordingly, no statutory right of withdrawal applies to such bookings.
6. Cancellation policy
Please note that, pursuant to Section 18 (1) (10) FAGG, no statutory right of withdrawal applies to bookings of language courses. The following cancellation conditions apply:
- Within 24 hours of registration and payment: 100% of the amount received by INNES will be refunded.
- Up to 30 days before the course or program start: 90% of the course fee received by INNES will be refunded. If 10% of the fee is less than EUR 44, EUR 44 will be retained instead.
- 29 to 15 days before the course or program start: 70% of the amount received will be refunded.
- 14 to 7 days before the course or program start: 50% of the amount received will be refunded.
- From 6 days before the start of the course or program: No refund will be issued.
Refunds are always calculated based on the amount actually received by INNES. If the course fee was paid via PayPal, credit card, or any other payment method with transaction fees, and the full course fee was not received by INNES due to such fees, the refund will also be based on the reduced amount actually received.
Cancellations must be submitted in writing by email.
7. Modification of course program / Cancellation of the course
INNES reserves the right to modify courses. Due to long-term planning, program changes cannot be ruled out.
By the same token, whether a course is held depends on whether the required minimum number of 4 participants sign up for the level. Therefore, INNES reserves the right to change course days, starting times, course venues and trainers. INNES reserves the right to cancel courses if fewer than 4 participants sign up. In this case, any course fees already paid will be refunded.
In the case of 4 participants signing up for the course, INNES reserves the right to shorten the course by 20%.
The above-mentioned changes or cancellations do not entitle anyone affected to reimbursement for expenses incurred and/or any other claims against INNES. The same shall apply to necessary short-term changes in the course schedule. If a course cancellation becomes necessary, the full amount paid by the customer shall be refunded. INNES assumes no liability for clerical or printing errors in its publications and websites.
8. Public holidays
No teaching takes place on public holidays. Lessons lost due to public holidays are compensated on other days during the course period. There will be no pro rata reimbursement of the course costs.
9. Course Certificate
In order to be issued a certificate at the end of the course, participants are required to attend a minimum of 80% of classes and achieve positive grades in the continuous tests. The certificate provides information regarding the completed course phase according to the Common European Framework of Reference for Languages. Course certificates shall be issued upon requirement free of charge to all participants who have attended a minimum of 80% of their respective classes.
10. Confirmation of attendance
If the criteria for receiving the course certificate are not met, confirmation of attendance can be issued upon request. Confirmation of attendance provides information about the course level and the number of learning units completed by the course participant.
11. Photos and videos
By registering for a German language course, you consent to any photos or videos taken of you at INNES venues being used in INNES promotional materials or online. If you do not consent, you have to notify us in writing before the start of the course.
12. Disclaimer
INNES does not accept responsibility for loss or theft of personal effects, including the learning materials made available. INNES provides the teaching infrastructure, while the responsibility for individual learning success lies with each participant. No guarantees can be issued for learning success.
13. Disability
In order to discharge our obligations under the Disability Discrimination Act, disabled customers are asked to provide sufficient information at the time of booking with regard to their disability to enable us to consider whether reasonable adjustments can be made to accommodate them.
14. Final Provisions, Applicable Law and Place of Jurisdiction
Amendments and modifications to the present Terms and Conditions must be made in writing to be legally valid. This also applies to any waiver of this formal requirement. Verbal ancillary agreements shall not be valid.
The contractual relationship is subject to the substantive law of Austria, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For any disputes arising from or in connection with this contractual relationship, including disputes concerning its validity, the parties agree to submit to the exclusive jurisdiction of the competent court at the registered office of INNES, unless mandatory statutory provisions stipulate otherwise.
15. Data Privacy Protection
Personal data will be stored and processed electronically and treated with the utmost confidentiality. Your personal data will not be disclosed or made available to third parties, except to fulfil legal obligations, and shall be utilized exclusively for internal purposes. In order to ease the internal communication, the personal information entered in the application may be given to teachers or other INNES staff.
